Terms & Conditions

Art. 1 — General provisions
The web store on the website of Izindlovu Fund, a non-profit organization with registered office at Hertendreef 4, 2970 Schilde with VAT BE0738.518.012 (hereinafter Izindlovu) offers its customers the opportunity to purchase products from its web store online. These general terms and conditions apply to all purchase and sales contracts concluded by a visitor to this website, hereinafter referred to as "customer", with Izindlovu Fund. These general terms and conditions shall always prevail over any other terms and conditions of the customer. Additional terms and conditions of the customer are excluded, except when previously, in writing and expressly accepted by us.

Art. 2 — Price
All mentioned prices are expressed in EURO, inclusive of VAT and all other Belgian taxes to be paid by the customer and exclusive of import and other taxes charged for shipment to a country outside Belgium. Where payment is made using Bitcoin or another crypto-asset, the EUR value is determined at the moment of payment confirmation based on the exchange rate used by Izindlovu or its designated payment provider.

Art. 3 — Online purchases
An agreement is validly concluded when the order is sent electronically by clicking on the "complete order" button, or by sending an e-mail containing an order.

Art. 4 — Retention of title
The delivered items remain the exclusive property of Izindlovu until full payment by the Client. The Client undertakes, if necessary, to inform third parties of Izindlovu's retention of title, e.g. to anyone who would come to seize the items not yet paid in full.

Art. 5 — Right of withdrawal
The customer has the right to notify the seller that he renounces the purchase, without payment of any penalty and without giving any reason within 14 working days from the day following the delivery of the product or the conclusion of the service agreement, provided that the purchased products are returned to Izindlovu in their original packaging and without damage. However, food items cannot be taken back.

⚠️ Payments made using Bitcoin or other crypto-assets are irreversible. In the event of a valid withdrawal, refunds (if applicable) will be made in EURO and not in crypto-assets, unless explicitly agreed otherwise. The Customer hereby bears the costs for the return delivery. The Customer must return or hand over the goods to Izindlovu, Hertendreef 4, 2970 Schilde, without delay, but in any event no later than 14 calendar days from the day on which he communicated his decision to withdraw from the contract.

Art. 6 — Payment
Payment is always made electronically, by bank transfer, or — where offered — by Bitcoin or another crypto-asset. Each order is immediately payable upon conclusion of the agreement. Where Bitcoin or another crypto-asset is used:

  • The transaction is final once confirmed on the relevant blockchain.
  • Izindlovu does not provide crypto-asset custody services.
  • Crypto-assets received are treated as payment or donation to Izindlovu Fund.
  • Izindlovu is not responsible for errors caused by incorrect wallet addresses provided by the customer.

Art. 6bis — Bitcoin and Crypto-Asset Donations (MiCAR clause)

Where Bitcoin or other crypto-assets are accepted as donations:

  • All crypto-assets are accepted as a donation to Izindlovu Fund.
  • Ownership transfers to Izindlovu Fund upon receipt.
  • Izindlovu Fund determines, in line with its mission and governance framework, how and when donated funds are allocated.
  • Donations do not create a legal entitlement to a specific project, timing, or partner.
  • Izindlovu Fund does not hold crypto-assets on behalf of third parties.
  • Izindlovu Fund does not provide crypto-asset investment advice or crypto-asset services within the meaning of MiCAR.

Art. 7 — Execution of the agreement — dispatch and delivery
The execution of the agreement or delivery normally takes place almost immediately after payment. However, any delay in execution does not give any right to compensation. In case of payment by bank transfer, the delivery of the ordered products takes place within five working days after crediting our account. The seller will make every effort to meet the stipulated delivery deadlines, which are only indicated approximately.

Art. 8 — Complaints
Any complaints must be well-founded and duly motivated and notified to us within 8 days after receipt of the goods. Warranty for hidden defects is granted for a non-renewable period of 6 months from delivery and on condition that the seller is notified within 72 hours of discovery. No goods may be returned without the seller's prior written consent. Customer service can be contacted via e-mail info@izindlovu.org or by post at Hertendreef 4, 2970 Schilde, Belgium.

Art. 9 — Proof
The Customer accepts that electronic communications and backups can serve as evidence.

Art. 10 — Applicable law — Disputes
All disputes arising from this agreement shall be governed by Belgian law. For all disputes arising from this agreement, the Court of Antwerp is competent.

Art. 11 — Acceptance of general terms and conditions
With each electronic order of products, the customer expressly declares that he accepts these general terms and conditions.
